Welcome to SkinBalance. These Terms of Service ("Terms") govern your use of the SkinBalance web application (the "Service"), provided by Aaron Alvarez Enterprises, the business behind SkinBalance ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Description of Service

SkinBalance is a tool designed to help photographers analyze skin tones in portrait photos and receive guidance for color correction. The Service is provided through our web application at go.skinbalance.app.

2. User Accounts

To access the Service, you must register for an account. You agree to provide accurate and complete information and to keep this information up to date. You are responsible for all activities that occur under your account and for keeping your password confidential.

3. Subscriptions and Billing

The Service is offered on a subscription basis, with a free tier and a paid tier ("SkinBalance Plus").

Billing: All payments are processed by our third-party payment processor, Stripe. By purchasing a subscription, you agree to their terms.
Recurring Charges: Paid subscriptions are billed in advance on a recurring monthly or annual basis. Your subscription will automatically renew at the end of each billing period unless you cancel.
Cancellations: You may cancel your subscription at any time through your Account page, which will direct you to the Stripe customer portal. Your cancellation will take effect at the end of the current billing period, and you will not be charged again. No refunds will be provided for partial subscription periods.

4. Acceptable Use

You agree not to use the Service for any unlawful purpose or to:

Analyze any images for which you do not have the proper rights or permissions.
Attempt to reverse-engineer, decompile, or otherwise access the source code of the Service.
Interfere with or disrupt the operation of the Service.

5. Intellectual Property

Our Service: We own all rights, title, and interest in and to the SkinBalance Service, including our logo, branding, and the underlying technology.
Your Content: You retain full ownership of your original images. We do not upload, store, or claim any ownership over your content. The Service works by processing your image locally within your browser; only anonymized color data from the selected facial area is used for the analysis.

6. Disclaimer of Warranties

The Service is provided "as is" without any warranties of any kind. We do not guarantee that the Service will be error-free or that the analysis results will be perfect for every situation.

7. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Service.

8. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles.

9. Dispute Resolution and Arbitration

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
